Pickleball Pods – Terms of Service

This Terms of Service Agreement (“Agreement”) governs participation in the Pickleball Pods program (“Program”) offered by Heights Athletic Club (“HAC,” “we,” or “our”). By registering for the Program, you (“Participant”) agree to the following:

1. Registration and Participation

1.1 Registration is first-come, first-served. Submission of the registration form and payment confirms enrollment.
1.2 Participant agrees to commit to the group’s established schedule for the full duration of the Program. Because Pods operate in fixed groups, consistent attendance is essential.

2. Program Fees

2.1 The Program fee is one hundred forty-nine dollars ($149) for HAC members and two hundred forty-nine dollars ($249) for non-members.
2.2 Payment is due at the time of registration through the online form. Registration is not confirmed until payment is completed.

3. Cancellation and Refund Policy

3.1 All Program fees are non-refundable once registration is submitted.
3.2 No partial refunds, credits, or transfers will be issued for missed sessions or withdrawal after registration.
3.3 Due to the fixed group format, sessions cannot be rescheduled or made up for individual Participants.

4. Media Release

4.1 Participant grants HAC permission to photograph, record, or otherwise capture their likeness during Program activities.
4.2 Participant understands that such media may be used for marketing, promotional, training, and educational purposes without compensation.
4.3 All rights to such media belong exclusively to HAC.

5. Assumption of Risk and Release of Liability

5.1 Participant understands that pickleball and related activities involve inherent risks, including but not limited to injury, illness, and property damage.
5.2 Participant voluntarily assumes all risks associated with participation.
5.3 To the fullest extent permitted by law, Participant releases and holds harmless HAC, its owners, employees, contractors, and affiliates from any claims or liabilities arising from participation in the Program.

6. Acknowledgement and Agreement

By completing the registration and submitting payment, Participant acknowledges that they have read, understand, and agree to be bound by this Agreement.
