Organization: The Heights Athletic Club / Dynamite Pickleball (“Club,” “we,” “us,” or “our”)
1. Eligibility
Youth clinics and programs are open to minor participants registered by a parent or legal guardian who is at least 18 years of age. The registering adult represents and warrants that all information provided is accurate and complete and that they have legal authority to enroll the minor participant.
2. Registration & Program Placement
Registration must be completed through the Club’s designated registration platform. Program placement is subject to availability, enrollment minimums, skill grouping, and capacity limits. The Club reserves the right to adjust participant groupings, instructors, schedules, or session structure in its sole discretion for operational, safety, or instructional purposes. Registration is not final until payment is successfully processed.
3. Program Fees, Promotions & Giveaway Terms
All program fees are due at the time of registration unless otherwise stated. Promotional discounts, including limited-time pricing offers, apply only to the specific session selected at registration and have no cash value, are non-transferable, and may not be combined with other offers unless expressly stated.
If a promotional giveaway is offered, all eligible registered participants will be automatically entered. If a registered participant is selected as the official winner, the Club will issue a refund of the program fee paid for the applicable session. Refunds apply only to the amount actually paid and do not include incidental costs. Giveaway terms may be modified or discontinued at the Club’s discretion prior to drawing.
Unless otherwise stated in writing, program fees are non-refundable once the session begins. The Club reserves the right to modify pricing or promotional structures at any time prior to registration completion.
4. Communications & Required Notifications
By registering, you consent to receive transactional and program-related communications via email and/or text message necessary to administer and deliver the program. These communications may include:
– Registration confirmations and receipts
– Scheduling updates or time changes
– Weather-related cancellations or facility notices
– Instructor or program adjustments
– Safety or emergency communications
These communications are operational in nature and are required for participation. Standard message and data rates may apply.
You may separately elect to receive promotional or marketing communications regarding future programs, memberships, events, or special offers. Marketing consent is not a condition of purchase and may be withdrawn at any time by replying STOP to text messages or using the unsubscribe link in email communications.
5. Use of Information
Information provided during registration may be used for program administration, operational notices, safety communications, customer service, and—if you have opted in—marketing and promotional outreach. The Club does not sell personal information. Information may be shared with service providers solely as necessary to operate programs, process payments, or comply with applicable law.
6. Photo & Media Release
Unless the parent or legal guardian provides written notice prior to the first session, participation constitutes consent for the Club to use the participant’s first name, image, or likeness in photographs or video recordings for promotional, marketing, or educational purposes where permitted by law.
7. Conduct & Removal
The Club reserves the right to remove any participant whose behavior is unsafe, disruptive, or inconsistent with Club policies. Removal may occur without refund if policies are violated.
8. Assumption of Risk & Limitation of Liability
Participation in tennis and pickleball programs involves inherent physical risks. By registering, you acknowledge and voluntarily assume all risks associated with participation. Participation is subject to a separately executed liability waiver and release agreement. To the fullest extent permitted by Texas law, the Club and its owners, employees, contractors, and representatives shall not be liable for injury, loss, or damage arising from participation, except in cases of gross negligence or as otherwise required by law.
9. Program Modifications
The Club reserves the right to modify, suspend, or cancel programs due to weather, enrollment levels, instructor availability, facility constraints, or other operational considerations. In the event of cancellation prior to the start of a session, a credit or refund may be issued at the Club’s discretion.
